What Is Criminal Sexual Misconduct?
Being Accused of Sexual Misconduct Can Change Your Life
Sex crime allegations can send your life into a tailspin, and being convicted could result in fines, jail time, and being registered on Michigan’s public Sex Offender Registry. Before you walk into the courtroom, you need to speak with a criminal defense attorney and start building your case. These cases are complicated, so it’s important to choose a criminal defense law firm that is fearless, dedicated, and experienced. Revolution Law PLC is proud to offer bold representation for clients charged with anything from first to fourth-degree criminal sexual conduct in Michigan.
There are four degrees of CSC (Criminal Sexual Conduct) in Michigan, each with different penalties and elements that must be proven in order to be convicted.
CSC 1st Degree:
This is the most serious degree of CSC and is punishable by up to life in prison. To be convicted of CSC 1st degree, the prosecutor must prove that the defendant engaged in sexual penetration with another person by force or coercion, or that the victim was incapacitated or mentally incapable of giving consent.
CSC 2nd Degree:
This degree of CSC is punishable by up to 15 years in prison. To be convicted of CSC 2nd degree, the prosecutor must prove that the defendant engaged in sexual contact with another person by force or coercion, or that the victim was incapacitated or mentally incapable of giving consent.
CSC 3rd Degree:
This degree of CSC is punishable by up to 15 years in prison. To be convicted of CSC 3rd degree, the prosecutor must prove that the defendant engaged in sexual penetration or sexual contact with another person without their consent.
CSC 4th Degree:
This degree of CSC is punishable by up to 2 years in prison. To be convicted of CSC 4th degree, the prosecutor must prove that the defendant engaged in sexual contact with another person without their consent.
It's important to note that a conviction for CSC will result in lifetime registration as a sex offender in the state of Michigan. This can have a significant impact on a person's life, including restrictions on where they can live and work, and can make it difficult to find employment or housing.
If you have been accused of CSC in Michigan, it is important to seek legal representation from a criminal defense attorney who has experience in this area of law. A skilled attorney can help you understand the charges against you and develop a defense strategy that is tailored to your specific case.
A lawyer can also help you to understand your rights and options, including plea bargaining, and can work to have the charges against you reduced or dropped.
It's important to remember that you are innocent until proven guilty and it's crucial to have a legal representation that can defend you in a court of law.
